Terms & Conditions

Introduction

These Terms and Conditions govern participation in expeditions, courses, treks, climbing programs, and other services organized by Breakthrough Mountain Adventures.

By booking a program or participating in any activity organized by Breakthrough Mountain Adventures, participants acknowledge that they have read, understood, and agreed to these Terms and Conditions.

Breakthrough Mountain Adventures operates in remote mountain environments including Peru and Chile. Participation in these activities involves inherent risks which cannot be eliminated.


Booking and Payment

A 30% non-refundable deposit is required to confirm a reservation.

The remaining balance must be paid 60 days before the start of the program.

If a booking is made within 60 days of the program start date, full payment is required at the time of booking.

Once a reservation is confirmed, Breakthrough Mountain Adventures begins logistical preparation for the expedition or program. This may include guide scheduling, transportation arrangements, equipment planning, accommodation reservations, and coordination with local service providers.


Cancellation by Participant

All cancellations must be made in writing.

Because expeditions require significant planning and coordination, cancellation policies reflect the logistical commitments made in advance.

More than 60 days before the program start date

Participants may cancel and receive a refund of 60% of the total program price.

The remaining 40% is retained to cover administrative costs, planning time, and logistical preparation already undertaken.

Once a program is booked, planning and coordination begin immediately. This includes scheduling guides, coordinating logistics, and reserving time and resources specifically for the expedition.


Between 45 and 59 days before the program start date

Participants may cancel and receive a refund of 30% of the total program price.

At this stage significant logistical commitments have already been made.


Less than 45 days before the program start date

No refund will be issued.

At this stage guides, horses, transportation, accommodation, and other logistical services have already been confirmed and reserved specifically for the expedition. These services are paid in advance and cannot be recovered.

In addition, reserving a place on the expedition prevents guides and staff from accepting other work during that period.


Replacement Participants

If a participant cancels and their place is successfully filled by another participant, a partial refund may be considered at the discretion of Breakthrough Mountain Adventures.


Cancellation or Changes by Breakthrough Mountain Adventures

Breakthrough Mountain Adventures reserves the right to modify itineraries or cancel programs due to factors including but not limited to:

  • weather conditions

  • mountain conditions

  • safety considerations

  • guide illness or injury

  • logistical limitations

  • natural events or political circumstances

If a program must be cancelled by Breakthrough Mountain Adventures before it begins, participants may receive a credit toward a future program or a partial refund depending on recoverable costs.


Itinerary Flexibility

All itineraries are subject to change due to weather, mountain conditions, safety considerations, or other factors beyond our control.

Summits, routes, and specific objectives cannot be guaranteed.

Guide decisions regarding safety, route selection, pace, and itinerary adjustments are final.


Participant Responsibilities

Participants are responsible for:

  • maintaining appropriate physical condition

  • following guide instructions

  • using appropriate equipment

  • disclosing relevant medical conditions

  • respecting safety procedures

Failure to follow guide instructions or safety protocols may result in removal from the expedition without refund.


Horse Riding Safety

Horse trekking involves interaction with large animals in mountainous terrain.

Participants must follow all safety instructions provided by guides and staff, including maintaining appropriate distance between horses and respecting handling guidelines.

Horses may behave unpredictably, and participants acknowledge the risks associated with horseback riding.


Rescue and Emergency Response

Programs take place in remote mountain environments where professional rescue infrastructure may be limited.

Rescue operations may involve guides, local community members, park authorities, or private services.

Helicopter evacuation may be available in some regions but cannot be guaranteed.

All costs associated with rescue, evacuation, or medical treatment are the responsibility of the participant.


Insurance Requirement

All participants must carry appropriate travel and rescue insurance covering:

  • mountaineering

  • climbing

  • trekking

  • horseback riding

  • medical treatment

  • emergency evacuation

Participants are responsible for ensuring their insurance policy covers the activities undertaken during the program.


Limitation of Liability

Breakthrough Mountain Adventures operates according to professional mountain guiding standards and takes reasonable precautions to reduce risk. Our programs are led by experienced guides familiar with the terrain and conditions of the regions in which we operate, including guides trained within internationally recognized mountain guide systems such as the UIAGM/IFMGA framework where applicable.

Mountain activities involve inherent risks including but not limited to:

  • rockfall

  • avalanches

  • weather changes

  • altitude illness

  • terrain hazards

  • animal behavior

By participating in programs organized by Breakthrough Mountain Adventures, participants acknowledge and accept these risks.


Governing Law

These Terms and Conditions are governed by the laws of the Republic of Peru.

POLÍTICA Y CONDICIONES

Introducción

Los presentes Términos y Condiciones regulan la participación en expediciones, cursos, trekkings y programas organizados por Breakthrough Mountain Adventures.

Al reservar o participar en cualquiera de nuestros programas, el participante confirma que ha leído y acepta estos términos.


Reservas y Pagos

Se requiere un depósito no reembolsable del 30% para confirmar una reserva.

El saldo restante debe pagarse 60 días antes del inicio del programa.

Si la reserva se realiza dentro de los 60 días previos al inicio del programa, el pago completo será requerido al momento de la reserva.

Una vez confirmada la reserva, comienza la planificación logística del programa, incluyendo coordinación de guías, transporte, alojamiento y servicios locales.


Cancelación por el Participante

Todas las cancelaciones deben realizarse por escrito.


Más de 60 días antes del inicio

El participante recibirá un reembolso del 60% del precio total del programa.

El 40% restante se retiene para cubrir costos administrativos y planificación logística.


Entre 45 y 59 días antes

Se otorgará un reembolso del 30% del precio total del programa.


Menos de 45 días antes

No se realizará ningún reembolso.

En este punto, guías, caballos, transporte, alojamiento y otros servicios ya han sido confirmados y reservados específicamente para la expedición.


Reemplazo de Participantes

Si el lugar del participante cancelado es ocupado por otra persona, Breakthrough Mountain Adventures podrá considerar un reembolso parcial a su discreción.


Cambios o Cancelaciones por la Empresa

Breakthrough Mountain Adventures se reserva el derecho de modificar itinerarios o cancelar programas por motivos de seguridad, clima, condiciones de montaña u otros factores fuera de nuestro control.


Flexibilidad de Itinerario

Los itinerarios pueden cambiar debido a condiciones climáticas o de seguridad.

Las decisiones del guía son finales.


Responsabilidades del Participante

Los participantes deben:

  • seguir instrucciones del guía

  • mantener condición física adecuada

  • usar equipo apropiado

  • respetar normas de seguridad


Seguridad en Cabalgatas

La equitación implica riesgos asociados con animales grandes en terreno montañoso.

Los participantes deben mantener distancia adecuada entre caballos y seguir instrucciones de los guías.


Rescate y Evacuación

Las actividades se desarrollan en zonas remotas donde los sistemas de rescate pueden ser limitados.

Las operaciones de rescate pueden involucrar guías, comunidades locales o autoridades.

Los costos de rescate o evacuación son responsabilidad del participante.


Seguro

Todos los participantes deben contar con seguro que cubra actividades de montaña y evacuación.


Ley Aplicable

Estos términos se rigen por las leyes de la República del Perú.
